RESPONDENT ROBERT S. MINTON'S AMENDED MOTION
TO WITHHOLD ORDER ON AND TO SET HEARING OF RESPONDENT'S
MOTION FOR ORDER TO SHOW CAUSE AND MOTION FOR MODIFICATION
AND IN CAMERA REVIEW OR EARLY TERMINATION OF PROBATION

The Respondent, ROBERT S. MINTON, JR., by and through his undersigned counsel, hereby requests this Honorable Court to withhold any preliminary order on the Respondent's Motion for Order to Show Cause and Motion for Modification and in Camera Review or Early Termination of Probation filed with the Clerk of Court on July 12, 2001, and to set the same motion for hearing, and as grounds therefore would state:

1. The Respondent's undersigned counsel has received a faxed copy of the Petitioner's Motion to Summarily Deny Application for Order to Show Cause, or in the Alternative, for a Hearing, dated July 12, 2001.

2. The Respondent's undersigned counsel has also been contacted by Michael Hertzberg, Esq., co?counsel for the Petitioner, who expressed concern that the Court would issue an order to show cause based upon the Respondent's motion before any party would have an opportunity to be heard by the Court, to which the Respondent's undersigned counsel agreed that this matter should be heard before an Order issues.

3 This amended motion is substituted for Respondent's Unopposed Motion to Withhold Order based upon a subsequent telephone communication with Michael Hertzberg, Esq., correcting a misunderstanding in communication with counsel.

4. The Respondent's motion should be set and heard by the Court before any orders issue on the Respondent's motion. WHEREFORE, the Respondent requests this Honorable Court to set the Respondent's motion for hearing and to otherwise withhold any order on the Respondent's motion.
